1. Definitions
1.1 “Company” refers to Mad Witch Limited. 1.2 “Customer” refers to any individual or business purchasing goods from the Company. 1.3 “Goods” refers to the products supplied by the Company. 1.4 “Order” refers to a request by the Customer to purchase Goods.
2. General
2.1 These terms and conditions apply to all sales of Goods by the Company to the Customer. 2.2 By placing an Order, the Customer agrees to these terms and conditions. 2.3 The Company reserves the right to amend these terms at any time. Changes will apply to Orders placed after the amendments are published.
3. Orders
3.1 All Orders must be submitted via the Company’s website, email, or other approved communication methods. 3.2 Orders are subject to availability and acceptance by the Company. 3.3 A binding contract is formed when the Company confirms acceptance of the Order.
4. Pricing and Payment
4.1 Prices are quoted in GBP (£) and exclude VAT unless otherwise stated. 4.2 The Company reserves the right to adjust prices without prior notice, except for confirmed Orders. 4.3 Payment terms are Pro Forma or due within 30 days of invoice for credit account customers.
4.4 The Customer is responsible for any bank charges or transaction fees.
5. Delivery
5.1 The Company will make every effort to deliver Goods within the agreed time frame. However, delivery dates are estimates and not guaranteed. 5.2 Risk in the Goods passes to the Customer upon delivery. 5.3 The Company is not liable for delays caused by events outside its reasonable control.
6. Returns and Refunds
6.1 Goods may only be returned with prior written approval from the Company. 6.2 Refunds or replacements will be issued for defective Goods if reported within 3 days of receipt. 6.3 Custom or made-to-order items are non-returnable unless defective.
7. Warranty and Liability
7.1 The Company warrants that the Goods conform to their description and specifications. 7.2 The Company’s liability is limited to the price of the Goods. The Company is not liable for indirect or consequential losses. 7.3 The warranty does not apply to Goods that have been misused, altered, or damaged by the Customer.
8. Intellectual Property
8.1 All trademarks, designs, and intellectual property related to the Goods remain the property of the Company. 8.2 The Customer may not use the Company’s intellectual property without prior written consent.
9. Confidentiality
9.1 Both parties agree to keep confidential any non-public information obtained in the course of their business relationship.
10. Governing Law
10.1 These terms and conditions are governed by and construed in accordance with the laws of England and Wales. 10.2 Any disputes will be subject to the exclusive jurisdiction of the English courts.
